BIOLAGE "MAMMA MIA MOVIE PREMIERE” CONTEST
OFFICIAL RULES 1. ELIGIBILITY: Entrants for the Biolage "Mamma Mia! The Movie Premiere" Contest ("Contest") must be legal residents of the fifty (50) United States or the District of Columbia, 21 years of age or older. Employees of L’Oreal USA, Inc. (“Sponsor”), Universal Studios LLLP and its parent companies, affiliates, subsidiaries and advertising and promotion agencies, and the immediate family members (parent, spouse, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible for this Contest. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws and regulations. 2. HOW TO ENTER: To qualify to be entered into the Contest, you must submit an essay of 250 words or less describing your best hairstyling experience with a wedding party using Matrix Biolage Styling products. Hairstyling experience must be one of a stylist styling the hair of a wedding party. To submit an entry, visit www.matrix.com/mammamia (“Website”) beginning at 12:01 a.m. Eastern Time (“ET”) on March 1, 2008 through 11:59 a.m. ET on April 30, 2008,.. There is no limit on the number of Contest entries you can make, but they can only be made one at a time. Photos with submissions are not necessary. The Contest is subject to cancellation at any time if the Mamma Mia! The Movie Premiere ceremony is cancelled or postponed for any reason. 3. JUDGING: On or about May 15, 2008, a qualified panel of judges will review all eligible Contest entries and select a winner based on the following weighted criteria (Creativity 50%, Audience Appeal 25%, Brand Loyalty 25%). All decisions of the judges shall be final and binding on all entrants. Odds of winning depend on the number of eligible entries received. 4. WINNER NOTIFICATION: Winner will be notified by e-mail, telephone and/or mail. Winner will be required to complete and return an Affidavit of Eligibility and Liability and a Publicity Release ("Affidavit") within 14 days of date specified on notification, or an alternate winner will be selected. Failure to return required documents fully-executed within this time period, return of Affidavit of prize notification as undeliverable, or the inability of Sponsor to contact any potential winner will result in disqualification, and the prize will be awarded to an alternate winner. 5. PRIZES: A trip for two (2) to New York, NY to attend the movie premiere of “Mamma Mia!”. Trip includes roundtrip, coach-class air transportation from major airport near winner's home (determined by Sponsor in its sole discretion) to New York, NY; two (2) days, one (1) night hotel accommodations, (single room , double occupancy) (determined by Sponsor in its sole discretion), roundtrip ground transportation to/from airport and tickets for two (2) for the premiere of Mamma Mia! The Movie. Winner must be available to travel in the days surrounding July 16, 2008 or forfeit the prize. Trip is subject to availability and blackout dates. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child(ren) or sibling(s) of winner, travel companions must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Travel companions must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if Mamma Mia! movie premiere ceremony is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor's sole discretion. Approximate Retail Value ("ARV"): $2,500 USD. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. 6. OWNERSHIP/USE: By submitting an entry, each entry agrees Sponsor shall own the nomination and that it and its designees may exploit edit, publish, use, adapt, exploit, modify or dispose of such nomination, online, in print, film, television, or in any other media now or hereafter devised for advertising and promotional or other purposes worldwide in perpetuity without compensation or notification to the entry or any third party of any kind, except as prohibited by law. 7. GENERAL RULES: By participating, participants agree (i) to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all respects, (ii) to release and hold harmless Sponsor and its parent, subsidiaries, affiliates, advertising and promotion agencies, and the respective officers, directors, employees and agents of each of the foregoing (collectively, the “Released Parties”) for any injuries, damages, expenses or losses that may be sustained, in whole or in part, directly or indirectly, in connection with participation in the Contest or the acceptance, use or misuse of any prize awarded herein (including any travel or activity related thereto), and (iii) to the use by Sponsor and its designees of their names, likenesses, cities and states of residence, biographical information, and/or nominations (if applicable) for advertising and promotional purposes in any and all media now or hereafter devised worldwide in perpetuity, without compensation, notification or permission, unless prohibited by law. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled or illegible entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries/predictions, the judging of predictions, the announcement of the prizes or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Website. Persons who tamper with or abuse any aspect of the Contest or Website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated nominations will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of nominations, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the winner(s) from all eligible, non-suspect entries received prior to action taken using the judging procedures outlined above. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. In addition, any dispute relating to the Contest (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in the City and County of New York. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have. 8.
